Fillet on 3D Plane

Two examples are here. In 2nd example fill is not possible on different 3D planes. In the 1st example fillet is possible on different 3D planes. How can you explain this?

Hmm, you send a different file in the second example, but still:

A fillet sketch is an arc with tangency on both connection points, and it is not possible to apply tangency if the entities are not co-planar (the fillet would bend in a third dimension). Try using a spline instead, and apply tangency on the connections to get the picture.

One the first file you send the lines are co-planar, if you spin the sketch it is possible to make the lines overlap:

I didn't quite understand, I combined the two line ends in the second example and added a radius.

if there are two different 3d lines, the radius is not added. but a radius is added to lines on different planes within a single 3d line.
